I feel that people ask this question because they think it irritates Yankee fans, which it does, but using your logic, all of MLB has disrespected JR, for not retiring the number sooner. It shouldn't have been available for Rivera in 1995. But since it was, he went on his own to honor JR, and selected #42 as his number. It's not his fault that, later, MLB decides they want to honor JR by retiring the number. Mariano was just ahead of the game in his show of respect.Furthermore, ANY discussion of JR that results by Mariano wearing number 42 is what it's all about anyway, remembering Jackie Robinson.

No he should not.Any player that was wearing #42 when the number was retired was allowed to continue wearing it no matter where they were playing unless it had been previously retired by their new team. Mariano Rivera just happens to be the last player to be still wearing it after the Commissioner's decree.
I think it is probable that the Yankees will also retire it in Mariano Rivera's name when he retires as well. They already have a number retired for two players; #8 for Yogi Berra and Bill Dickey.
