Friday had been a milestone for 3-year-old Josiah Wineberger: It was the first day the recently potty-trained toddler had stayed dry all day at nursery school.

For this achievement, Josiah's father said, the school gave his son a badge, which he proudly wore all day until it was time to go to BayWalk after dinner to celebrate his brother's birthday with video games and ice cream.

Josiah strolled through the plaza alongside his father, licking just one side of his ice cream until the scoop threatened to fall off the cone. John Wineberger noticed what appeared to be teenagers fighting and turned to make sure his other children were close by.

"The next thing I knew I felt a gust of wind and heard what sounded like a gunshot," Wineberger said. He saw his 11-year-old son, Michael, and 5-year-old daughter, Emma, but not Josiah. It took a split second for Wineberger to realize Josiah lay on the ground, motionless and bleeding.

He had been hit by a speaker that fell 20 feet from a balcony above, where a live band had just finished playing.

"I thought someone had shot him in the head," Wineberger said. He bent down to pick up his son. "I started yelling, 'Who did this? Who's responsible for this?' "

Wineberger said he didn't realize that Josiah's head injuries were actually from the speaker until someone tapped him on the shoulder and told him.

Josiah, who loved Buzz Lightyear so much he wore the Halloween costume year-round, underwent several hours of surgery late Friday night. Officials with All Children's Hospital said Saturday he was in critical but stable condition. Wineberger said the surgery went as well as it could, but said there were complications.

"He's responsive to his name, but he's very, very critical," Wineberger said. He said family members were traveling to St. Petersburg to be with Josiah. "Right now, all we're concerned about is him."

Officials were still at a loss Saturday to explain how the speaker fell over the edge of the balcony onto the 35-pound boy.

No police reports were available Saturday, and a statement issued by the Sembler Co., which owns and manages BayWalk, said the company was still collecting information.

"Right now, the only concern of the Sembler Company is that this family has the time and space they need to give care and support to and for their child and we have expressed this to the family directly," said Sembler president and CEO Craig Sher.

It wasn't clear how heavy the speaker was that injured Josiah, but speakers of that type range in weight from 49 pounds to 78 pounds, according to the Web site of manufacturer Electro-Voice.

Wineberger said the family, which includes his wife and 2-month-old son, should know in a few days how severe Josiah's head injuries are. But the pint-sized Buccaneers fan has made it through the first critical 24 hours, Wineberger said.

And Wineberger is hoping his son will soon be able to don his tiny wrestling belt again, a la "The Champ" John Cena, and ask his father: "You want a piece of me?"

"We're praying right now," Wineberger said.

Though he appeared to be unconscious immediately after he was hurt, Josiah did awaken a few minutes later, said St. Petersburg Fire Rescue spokesman Rick Feinberg.

"The child was awake during our treatment," Feinberg said. Josiah was waken to Bayfront Medical Center, and later transferred to All Children's Hospital.

Gianmarc Manzione, an English instructor at the University of South Florida, didn't see the speaker fall, but said the anguish of the crowd that surrounded the boy to wait for the ambulance was palpable.

"There were probably 70 to 100 people gathered there," said Manzione, who had been at the Ben & Jerry's shop when the accident happened. He said people were upset, and some were weeping. "I saw a couple of girls crying and running away."
