You should just hit the one-ball to avoid scratching again. There's no set rule that says what you have to do in this situation. I would graze the one-ball and leave my opponent with no shot on the one-ball without banking the ball, hoping that he/she will scratch. Depends on the local rules you are playing. typically four balls must hit a rail not including the cue ball before a legal break can occur. from what you said you didn't even hit the one ball. if that is the case you grab the cue ball and break again. if your opponent hit his shot inform him that was not a legal break and he must re-rack and you break again.How to shoot a ball in a pool game?

So, if the opponent just grazes the one ball and puts it behind the pack, he would commit a foul since only 1 ball (cueball) touched the cushion.
Besides, if your opponent miscues on the break, why not break the balls yourself? If you know how to break, you should have a 95-99% chance of potting a ball off the break! The wing balls are the easiest to pocket into the corner pocket.
